Not illegal at all as long as the games you are trading are unlicensed by their previous owners.

Why would someone trade a game they have just bought? Doesn't make sense to me.

They bought it and don't like it. Or they bought it and want to take advantage of a good trade opportunity. Or they buy a copy specifically to trade it to me and take advantage of a good trade opportunity :).
